itself, when applied in full, is much more comprehensive. Special Surrogate's Rules for each county may therefore be appropriate. But the general Surrogate's Rules should, we submit, be formulated by the Surrogates of all the counties met in assembly, and such rules should be promulgated only with the consent of the Judges of the Court of Appeals. An enabling provision of the Statute to that end would require some constructive legislation to give effect to this suggestion, but it would be of a character comparatively simple; certainly not difficult.

We do not venture at this time to offer any suggestions concerning particular substantive amendments to Chapter XVIII of the existing Code of Civil Procedure. That it is in need of some slight and formal amendments must be apparent to anyone familiar with the subject. But such changes need not be radical or extensive. When the time comes for revision and redaction of that Chapter for reenactment in a Surrogate's Code or otherwise, we shall be willing, if requested by the revisers, to give the subject such detailed consideration as its general importance demands of the Surrogates. We have, at the request of the Bar Association, been favored by suggestions from other Surrogates of this State for such amendments. These suggestions we submit with this communication, as they speak best for themselves. Some of these suggestions have our hearty approval, while others require our further consideration before we feel able to assent to them with entire conviction of their necessity.

Mr. President, I am requested, on behalf of the Committee on Nominations, to offer the report of that

committee, which has been printed and was distributed to the members of the Association prior to the meeting, in compliance with the provisions of our By-laws. I move, in accordance with our custom, that the Secretary be authorized to cast one ballot for the election of the gentlemen named to fill the offices set forth in that report, and that they be elected.

The motion was duly seconded and carried.

The Secretary cast the ballot as directed, and the President announced that the gentlemen reported by the committee were elected to the several offices named in the report of the Committee on Nominations.
