INTRODUCTION OF A BILL

AMENDMENT OF FOREIGN ASSISTANCE ACT OF 1961

The Senate, by unanimous consent, resumed the consideration of its unfinished business, viz, the bill (H.R. 11380) to amend further the Foreign Assistance Act of 1961, as amended, and for other purposes.

The question being on agreeing to the amendment (No. 1234) yesterday proposed by Mr. MCCARTHY (for himself, Mr. JAVITS, and Mr. HUMPHREY) as a substitute to the amendment (No. 1215) heretofore proposed by Mr. DIRKSEN (for himself and Mr. MANSFIELD) to the said bill.

INTRODUCTION OF A JOINT RESOLUTION

Mr. JAVITS introduced a joint resolution (S.J. Res. 204) to amend the Constitution of the United States to permit any State to apportion one house of its legislature on factors other than population with the approval of a majority of its voters; which was read the first and second times by unanimous consent and referred to the Committee on the Judiciary.

SELF-DETERMINATION FOR CYPRUS

Mr. KEATING (for himself and Mr. DOUGLAS) submitted the following concurrent resolution (S. Con. Res. 98); which was referred to the Committee on Foreign Relations:

Whereas the people of the United States respect the principle of self-determination and majority rule for all nations; and

Whereas the people of the United States deplore the violence and civil conflict that has erupted on the island of Cyprus where the right of the people of Cyprus to majority rule has been restricted; and

Whereas this conflict has brought two NATO allies into a quarrel endangering the long-term interests of both nations and of the Western alliance; and

Whereas the principal benefactors of the conflict are Communist nations and neutralist dictators trying to destroy NATO and eliminate American defenses and Western influence throughout the eastern Mediterranean; and

Whereas self-determination for the people of Cyprus, including possible union with Greece, would reduce Communist influence in Cyprus, bring Cyprus within NATO, and eliminate the threat of war between Greece and Turkey: Now, therefore, be it

Resolved, That it is the sense of the Congress that the historic American principle of self-determination should be applied to Cyprus with unconditional and internationally assured guarantees for the freedom and security of life, religion, and property for all minorities on Cyprus.

The question being on agreeing to the amendment (No. 1234) heretofore proposed by Mr. MCCARTHY (for himself and others as a substitute for the amendment (No. 1215) heretofore proposed by Mr. DIRKSEN (for himself and Mr. MANSFIELD) to the said bill.

Mr. JAVITS modified the pending amendment (No. 1234).

Mr. President: The House of Representatives has disagreed to the amendments of the Senate to the bill (H.R. 11865 to increase benefits under the Federal old-age, survivors, and disability insurance system, to provide child's insurance benefits beyond age 18 while in school, to provide widow's benefits at age 60 on a reduced basis, to provide benefits for certain individuals not otherwise eligible at age 72, to improve the actuarial status of the trust funds. to extend coverage and for other purposes, it agrees to the conference asked by the Senate on the disagreeing votes of the two Houses thereon, and has appointed Mr. MILLS. Mr. KING of California, Mr. BOGGS, Mr. BYRNES of Wisconsin, and Mr. CURTIS managers at the same on its part.

The Senate resumed the consideration of its unfinished business, viz, the bill (H.R. 11380) to amend further the Foreign Assistance Act of 1961, as amended, and for other purposes.

It is the sense of the Congress that in any action or proceeding in any court of the United States or before any justice or judge of the United States in which there is placed in question the ralidity of the composition of any house of the legislature of any State or the apportionment of the membership thereof. 1 reasonable time should be accorded to such State to conform to the requirements of the Constitution of the United States relating to such composition or apportionment, and (2) in the event that a proposed amendment to the Constitution of the United States relating to the composition of the legislatures of the several States, or to the apportionment of the membership thereof, has been duly submitted by the Congress to the States for ratification, such fact be taken into consideration in framing a decree for relief.

Sec. 501. Following section 1258 of title 28 of the United States Code (28 U.S.C., sec. 1258) add a new section as follows: "1259. Supreme Court, Limitation of Appellate Jurisdiction

"The Supreme Court shall not have the right to review the action of a Federal court or a State court of last resort concerning any action taken upon a petition or complaint seeking to apportion or reapportion any legislature of any State of the Union or any branch thereof."

Sec. 502. Amend title 28, section 1331 of the United States Code (28 U.S.C., sec. 1331) by adding at the end thereof a new subsection to read as follows:

"(c) The district courts shall not have jurisdiction to entertain any petition or complaint seeking to apportion or reapportion the legislature of any State of the Union or any branch thereof." It was determined in (Yeas the negative____ Nays 56 The yeas and nays having been heretofore ordered.
